I have always drooled over Isaac’s Fine Jewelry (EbayID - issacjewelry) on Ebay. In particular I fell in love with a marquise semi mount he had on Ebay. I sent this question about the setting through ebay: "Will an 11 x 5.5mm fit in this mount?" He replied "Definitely, that is the size stone it takes".
It was Buy It Now or Best Offer. I try to never pay full price, so of course I submitted a best offer. The best offer expired with no reply or counter offer from him. So I thought…ok…maybe that was too low, so I upped my offer another $100 and submitted another offer. The time ticked away and no response again (to decline or counter offer). It made me mad. I am of the opinion if you have a Best Offer on your auction and you don’t have it set up to automatically decline if the offer is lower than what your willing to accept…then decline it yourself or better yet counter back (common courtesy)! Otherwise don’t put Best Offer on there if you don’t intend to respond…period! After the second offer went unanswered I wrote him through - ask a question about this item on Ebay and said “Are you on vacation…I have submitted 2 offers and neither one have been declined or countered?”. He wrote me back then through his own personal email and said he could not do it for less than $_____. I emailed him back and countered lower than what he was asking. It took him a few minutes to respond and he told me he would do that for me…DIRECT and gave me the phone number to his store in Boca Raton. I knew that he was letting me have it for the lower price as long as it was not done through Ebay. I should have known better, but I really wanted that setting. I called him on the phone and after we confirmed the price he asked me would I like him to size it…”I said thank you and told him I needed it to be a size 5 1/4.” He said they would size it that day and over night it the next day and then he put me on the phone with a lady who took all my credit card information including verifying what size I wanted it to be.
The next day came and went and I had not received an email with tracking info, so I wrote him that evening and asked what the tracking number was so that I could make sure I would be home when it arrived. He wrote me back and said that it had not shipped yet and would now go out the next day. I said ok….what choice did I have. Well the next day he wrote me and told me my ring was beautiful and had been sized and gave me a tracking number. I tracked it and saw that I would have it by 3pm the next day. I was waiting with loupe in hand (lol). It came and I tore into the box. I opened it and could not believe what I was seeing. There are four straight prongs in the picture on the auction and three of them were bent over indicating it had been set with a stone prior. His auction shows a brand new unused - unset semi mount that will take a 1 to 2 carat stone. I was mortified. It took me all of 5 minutes to gather myself and call him on the phone. I asked for him and they put him on. I asked him what is going on “This semi mount has 3 bent over prongs and they are gouged and one is far to thin than the recommended 50% they should be in thickness once they are seated for a stone”. He told me that of course they are bent…his bench left them that way when they removed the 1 carat marquise diamond that was in it…that they only had to straighten back out one prong to remove the stone. “I said excuse me?…Your auction shows pictures of a brand new unset semi mount.” He said that he takes pictures of all his semi mounts when they first come in and because he has jewelry store as well, that he then sets a diamond in them. He then said if a customer is willing to pay full price then he would order them a brand new semi mount. “I said that is not what you advertised and another thing I can’t get the ring on my finger either…it doesn’t fit!” He said don’t worry we will set your stone for you…send it back to me with your stone and we will fix it. This was not what was supposed to happen…I did not want him setting my stone. I went to a local jeweler and asked them to tell me what size the ring was…It was a 4 3/4. No wonder I couldn’t get it on. The jeweler also told me he would not set my stone as the prongs were to weak and flimsy now and one looked like it had been re-attached (the one that was straight) and they would probably break during setting. I was very upset at this point. I called Isaac the next day and told him what size the ring was and that it was supposed to be a 5 1/4 and what the jeweler had said. I told him what I bought from him was supposed to be a brand new unset mount. His auctions clearly states that if the ring is sized there are No Returns. I told him I was not comfortable in sending him my stone…that all I wanted was what I paid for….A brand new unset semi mount in a size 5 1/4 and that is all I would except. He told me the jeweler I took my ring to didn’t want to set my stone because I didn’t buy the mount from him (so in essence the jeweler didn‘t know what he was talking about). “He said the mounting I sold you is exactly as described as the one in the picture. He said it has been modified because you asked us to size it for you, so it is non-returnable.”
I could no longer talk on the phone with him at this point. I felt emails were best and that way there could be no He said - She said. I called my credit card company to open an investigation and I wrote him an email:
Issac, I just got off the phone with American Express. I am opening an investigation with them because I did not receive the item I purchased from you (An unset brand new Semi-Mount). When I received this ring...I called you immediately and was told a bunch of things which have nothing to do with the fact that you misrepresented to me what I was purchasing. As for the ridiculous statement you just made to me regarding that the jeweler doesn't want to set the stone because I didn't buy the setting from him. Wrong! I took 2 settings and 2 stones to him. He is setting the other stone in the setting I brought in but did not buy from him, but he will not touch your setting for reasons I stated to you on the phone. I have done this several times in the past with this jeweler...so don't even go there with me. Not all jewelers are like you. I am not going to be blackmailed into further transactions with you. I purchased an unused brand new semi mount from you. I did not receive that. I am not going to be forced to send my stone and this ring back to you for you to work on. I do not trust you at this point. I want what I purchased or I want a refund. You can either refund my money or give me the brand new unset unused semi mount in which I ordered from you.
His response: That’s fine. Just send me the mounting back and I will send you a brand new one. Regards, Isaac
I ran to the post office and overnighted the ring to him (at my expense…so unfair). I really wanted this setting, but a brand new unset ring in the size I asked for.
The next day I wrote him this:
Isaac, I have not heard from you. I sent the ring yesterday overnighted to you. Can you please update me? Thank you
No response so I sent another one later that evening:
Issac, I would appreciate a response. The ring was signed for at 11:52am this morning.
The next day I received this email:
Hi S, We did receive your mounting back. We ordered a new mounting and we are waiting for it. We ordered you a whole new mounting in a size 5 1/4. It will be in next week so when it comes in we will contact you. Thank you for being patient. Regards, Isaac
I waited a few days and I sent an email asking about the status. Two days later I received this email from him:
Hello S, Your ring has come in and we will be sending it out today. It will be going USPS Express mail. Isaac
I received it the next day and guess what?…it was the same ring now with v prongs on the ends and straight prongs on the sides…and still the same size 4 3/4. I took it to a jeweler before I wrote this to him:
Issac, Where do I start? You advertise an unset brand new semi mount on Ebay with pictures to prove it. You sent me a previously set semi mount. You advertise you take best offers. Yet you will not respond when an offer is made, whether to decline or even counter back if the price is not what you will accept. No you choose to do it outside of Ebay by telling me that you will accept my offer but it has to be direct. You advertise no returns on items that have been re-sized. This is how you get customers and then you don't even size it right. The ring you advertise starts out being a size 6 1/2 and you offer to size it for me. I tell you...thank you and that I need it to be a size 5 1/4. You send me a ring that is a size 4 3/4. I call you within 20 minutes of receipt of this ring. You tell me some story about how you take pictures of these semi mounts for your auction and then proceed to mount stones in them (THAT IS FALSE EBAY ADVERTISEMENT)! You tell me on the phone that if someone wants to pay full price then you will order them a brand new semi mount (THAT IS NOT STATED ANYWHERE IN YOUR EBAY AUCTION...MORE FALSE ADVERTISEMENT)! You then blackmail me into I have to send the ring back to you at my expense and you will resize it and put my stone in it. I was not comfortable with that and ended up having to call my credit card company for you to do the right thing. BUT YOU DIDN'T...DID YOU? No I still had to send it back at my expense. And what do you send me back: You sent me back the very same ring that you have now added v prongs to and it is still size 4 3/4. You did not order a brand new semi mount in a size 5 1/4 like you said you would in an email that is attached below. I have one question for you Isaac....why? Why don't you want a happy customer? Why didn't you do the right thing? Why don't you want a customer for life.
I don't even know how to get on the phone with you because I am so angry that I ever entered a transaction with you outside of Ebay. I should have known better. I can't even leave you the feedback you deserve so that some other unsuspecting customer does not make the same mistake. I want to know what you intend to do about all of this? And please don't insult my intelligence with some song and dance that this is a brand new semi mount. I have proof it is the same ring.
He wrote back this:
Hi S, It is the same ring with a brand new mounting as I told you I was going to send you. The new mounting is the head where you're going to set your stone. I took the old mounting head off and I ordered a brand new head mounting specially for your 11x 5 mm marquise, had it resized to the correct size and it was all done in efforts to make you a happy customer! You can now take your moissanite to your local jeweler and have him set it in and he should not have to come up with any more excuses as to why he can't do it. I have bent backwards and forward for you and still you complain as if I am the bad guy. Set it and enjoy your new ring. Regards, Isaac

How do you order a whole new mounting in a size 5 1/4 if that's not a whole new ring. Are you telling me that the head comes in a size 5 1/4? You are being absolutely ridiculous now for me to actually believe that your email is not insinuating that your are ordering a brand new ring. When I tried on the ring after it arrived yesterday. It could not get it on again. So I took it to…not one but two different jewelers today and it is still a size 4 3/4. I want this resolved much more than you. I think you are dishonest and not anyone I would have ever entered into business with, had I known this beforehand. You will now have to pay for the ring to be sized correctly. I will accept nothing LESS!
I never received a reply from him. I just decided I didn’t want to go another round with him and let it go at that.
I want everyone to know that I never wanted my money back. I wanted this setting badly. I detest the lies he told me throughout this transaction especially about ordering a whole new mounting in a size 5 1/4. If all he intended to do was change the head (which by the way I had no idea could be done on this particular ring) and resize the ring correctly, I would have been more than fine with that. But he told me he was ordering a whole new mount in a size 5 1/4. The joke is on me since the ring started out as a size 6 1/2 and I had to pay to have it sized up to a 5 1/4. I don’t believe he thinks he did anything wrong based on everything he said by phone or in an email. For me that is the saddest part. I do not recommend this eBay vendor to anyone.

OMG! I would report him to ebay as him trying to solicit that you buy from him "behind ebay's back" - they don't have to know that you did! That's the least you could do to him as far as ebay is concerned...and I'd contact the cc company and stop payment and keep the damn ring anyway!

I think that everyone reading this should pick one of his items on ebay, email him and tell him that you would buy from him if you haven't heard that he was a jackass!!!!

OHMYGOSH. Girl. I am so sorry that you went through all that! If it is any consolation, the ring came out super gorgeous, and your marquise will be more protected with those v prongs I think... ((HUGS))
That was so cheap of him though. A mounting is a MOUNTING. I took that to mean a whole new semi mount. A whole new ring. If it was a new head he was talking about he should have said so.
And for goodness sake - MAKE IT THE RIGHT SIZE.

I'm so sorry you had to go through such dishonesty and lousy treatment. You did not deserve that! Please enjoy your new ring with the happiness and joy you deserve, hun! 
Thanks for the info on them. I almost bought from them, now I'm glad I didn't. I always wonder when people don't counter-offer.
